Court Dismisses $29M Investor Suit, Invalidating Indefinite Tolling Agreement
DPK defeated a U.S. investor's bid to enforce a $28.7 million arbitral award against the firm’s clients, who had been shareholders in a Chilean wine company. Judge Edgardo Ramos of the Southern District of New York dismissed the petition to enforce a 2012 Chilean arbitration award pursuant to the Panama Convention and the Federal Arbitration Act. Judge Ramos held that a tolling agreement signed by the parties, which purported to toll the statute of limitations indefinitely, was invalid under New York law, which governed the tolling agreement.
